1. Agreement to Terms

By accessing and using the Husky AI website and platform (huskystudio.ai and the Husky AI service, collectively the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Attempt to gain unauthorized access to the Service or bypass any security measures

Engage in automated access or scraping of the Service without authorization

4. Intellectual Property Rights

4.1 Our Intellectual Property

The Service, including all text, graphics, logos, images, software code, features, and functionality, is owned by Husky AI or its licensors and is protected by copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you any ownership rights or licenses to our intellectual property except as explicitly stated in these Terms.

4.2 Your Content

You retain all rights to content you create and upload to your website ("Your Content"). By uploading Your Content to the Service, you grant Husky AI a worldwide, royalty-free, non-exclusive license to:

Store, display, and distribute Your Content as part of providing the Service
Create backups and copies for security and operational purposes
Analyze Your Content using AI and machine learning for the purpose of improving our Service (unless you opt out)
Use anonymized, aggregated data derived from Your Content for analytics and product improvement

You represent and warrant that you own or have obtained all necessary permissions for any content you upload, including images, text, videos, and other materials. You are responsible for ensuring Your Content does not infringe on third-party intellectual property rights or violate any laws.

4.3 Third-Party Content

The Service may include third-party content, images, templates, icons, and other materials. Use of such third-party content is subject to the applicable third-party licenses and terms.

5. Acceptable Use Policy

You agree not to use the Service to create or host content that:

Is illegal, fraudulent, or deceptive
Violates intellectual property rights or privacy rights of others
Constitutes harassment, abuse, hate speech, or discrimination

We reserve the right to remove any content and suspend or terminate your account if you violate this Acceptable Use Policy. We are not responsible for the content of user-generated websites and are not obligated to monitor them, but we reserve the right to do so and take appropriate action when necessary.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUSKY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL HUSKY AI'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO HUSKY AI IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HUSKY AI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HUSKY AI DOES NOT WARRANT THAT:

The Service will be uninterrupted, error-free, or secure
Any defects in the Service will be corrected
The Service will meet your specific requirements or expectations
The Service will be compatible with all devices or browsers
Any content obtained through the Service is accurate or reliable

8. Indemnification

You agree to indemnify, defend, and hold harmless Husky AI, its officers, directors, employees, agents, and licensors from any and all third-party claims, damages, costs, and expenses (including attorneys' fees) arising from or related to:

Your use of the Service
Your violation of these Terms
Your violation of any applicable laws or regulations

9. Payment and Billing

9.1 Paid Plans

If you subscribe to a paid plan, you agree to pay all fees according to the pricing displayed at the time of purchase. Billing will occur monthly, annually, or at the interval you select. All fees are exclusive of applicable taxes unless otherwise stated.

9.2 Refund Policy

All payments are non-refundable except as required by law. If you dispute a charge, you must contact us within 30 days of the charge. If you cancel your subscription, your access to paid features will continue until the end of your current billing period, but no refund will be issued for the remaining balance.

9.3 Automatic Renewal

Your paid subscription will automatically renew at the end of each billing period using your stored payment method. You can cancel auto-renewal at any time by updating your account settings or contacting support. Cancellation will take effect at the end of your current billing period.

9.4 Price Changes

Husky AI reserves the right to change prices for paid plans at any time. We will provide at least 30 days' notice of any price increases. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

10. Service Availability and Maintenance

Husky AI strives to maintain continuous availability of the Service. However, we do not guarantee uninterrupted service. We may perform maintenance, updates, or repairs without notice, and the Service may be temporarily unavailable during such activities. We are not liable for any downtime, data loss, or interruption of service caused by maintenance or technical issues beyond our reasonable control.

11. Data Loss and Backups

While we employ industry-standard security measures and regularly back up data, we are not responsible for:

Loss or corruption of your data due to technical issues
Deletion of your content if your account is terminated for violation of these Terms
Loss of data due to your failure to maintain proper backups
Data loss resulting from events beyond our reasonable control (natural disasters, cyberattacks, etc.)

We recommend that you regularly download and maintain backups of your important data outside of the Husky AI platform.

12. Third-Party Links and Services

The Service may contain links to third-party websites, applications, and services. We are not responsible for the content, accuracy, or practices of third-party services. Your use of third-party services is governed by their terms of service and privacy policies. We encourage you to review those policies before using such services.

13. Termination

13.1 Termination by User

You may terminate your account at any time by accessing your account settings and selecting the option to delete your account. Upon termination, your access to the Service will be revoked, and your content may be deleted after a grace period.

13.2 Termination by Husky AI

We reserve the right to terminate or suspend your account and access to the Service immediately and without notice if:

You violate these Terms or applicable laws
You engage in harassment, abuse, or threatening behavior
Your use of the Service damages or impairs the platform
You fail to pay charges owed to us
We believe termination is necessary to comply with legal obligations or protect the rights of others

13.3 Effect of Termination

Upon termination, your license to use the Service terminates, your websites may be taken offline, and your content will be subject to deletion. Provisions that by their nature should survive termination, such as indemnification and limitation of liability, will remain in effect.
